Employment and Labor

Employment and labor issues are critical concerns for both employers and employees. Employers and employees both need to be protected at all times in the relationship, beginning with the first interview through termination.  Employees have many rights in the workplace that must be protected.  Employers may not discriminate against or harass an  employee on the basis of their gender, race, ethnicity, national origin, religion, disability, age, pregnancy, marital status or sexual orientation.  Furthermore, an employer may not refuse to hire a prospective employee for any of these reasons.  Also, employees are entitled to minimum wages ($9.00 per hour in California), overtime pay (time and a half after 8 hours, and double time after 12 hours), and meal and rest breaks.  Furthermore employees have a strict right of privacy regarding their personal and medical information.  There can be heavy penalties and damages if an employer violates any of these rights.

Employers also may not retaliate against employee whistleblowers.  That is, if an employee complains about conduct they reasonably believe is illegal, creates an unsafe work environment, is harassing or discriminatory, the employer cannot take any negative actions against them.  Otherwise, the employee would have the ability to seek remedies in Court or with one of several administrative body in California.
