Rights of Publicity and Privacy
Everyone knows that they have a right to privacy guaranteed to them by the United States and California Constitutions. However, what most people don’t know is that they have a legal right to their own names, pictures, likeness and voices, among other things. If someone uses your image (as in a drawing that looks very much like you), photograph, name or voice without your permission, this could very well be a violation of your right to publicity under California law.
Many people who do understand that such a right exists assume that it is a right only held by famous personalities. That is not the case. The Law Office of Joshua A. Burt represents both famous (Angelyne, for example) and ordinary Californians in protecting their rights of Privacy and Publicity.
